Tentang Program Pensiun, JHT, Pesangon, dan JP

Salah satu program dalam Undang-Undang No. 40 Tahun 2004 tentang Sistem Jaminan Sosial
Nasional (UU-SJSN) yang akan diselenggarakan oleh Badan Penyelenggara Jaminan Sosial (BPJS)
Ketenagakerjaan adalah Jaminan Pensiun (JP). Menurut ketentuan yang ada, JP ini mulai
diselenggarakan per 1 Juli 2015 dan bersifat wajib untuk seluruh pekerja di Indonesia dengan
membayar iuran.
Banyak kalangan khawatir bahwa kehadiran JP akan mengancam keberadaan Program Pensiun
yang sudah ada, yaitu yang diselenggarakan secara sukarela berdasarkan Undang-Undang No.
11 Tahun 1992 tentang Dana Pensiun (UU-DP), baik melalui Dana Pensiun Pemberi Kerja (DPPK)
maupun Dana Pensiun Lembaga Keuangan (DPLK). Apakah kekhawatiran ini beralasan?
Jawabannya tergantung – bisa ya, bisa tidak.
Beberapa pihak mengusulkan agar dilakukan harmonisasi antara JP dengan Program Pensiun.
Sedangkan pihak lainnya mengusulkan agar keikutsertaan dalam JP hanya diutamakan bagi
perusahaan yang belum menyelenggarakan Program Pensiun saja.
Sementara itu, bukankah kita mengetahui ada ketentuan dalam Undang-Undang No. 13 Tahun
2003 tentang Ketenagakerjaan (UUK-13) yang menyebutkan bahwa Program Pensiun itu (tidak
termasuk akumulasi iuran peserta beserta hasil pengembangannya, bila ada) dapat digunakan
sebagai kompensasi terhadap uang pesangon (Pesangon)? Oleh karena itu, wajar apabila
muncul pertanyaan bagaimana hubungan antara rencana “harmonisasi JP dan Program Pensiun”
ini dengan Pesangon? Kemudian dikatakan bahwa yang dimaksud dengan pengertian Program
Pensiun dalam UUK-13 itu termasuk JP dalam UU-SJSN.
Kalau semua yang dikatakan di atas itu memang benar dan dapat direalisasikan, maka tidak
salah kalau kita kemudian menyimpulkan hal-hal berikut ini:
